Opal Datagard is the sure way to ensure legal compliance with the Telephone Preference Service (TPS) register and Fax Preference Service (FPS) when you run a phone or fax campaign.
These national databases of people who have elected not to receive any kind of telemarketing calls are constantly updated. Current legislation obliges all telemarketing companies to screen their data against these registers before making any calls.
This legislation now applies to businesses, too - the DTI have put in place legislation that means businesses may register with the TPS/FPS to prevent unsolicited B2B sales calls.
Failure to comply with TPS legislation could result in legal action being taken against the client and a fine of £5,000 per complaint. In the event of such legal action, Opal can also support clients by providing legal evidence of the client's TPS/FPS compliance.
The Datagard system filters sales calls made by the client's call centre. Any numbers in the client's telephone number database that are matched to numbers in the TPS database are automatically excluded from dialling. Datagard sends an automated message back to the sales agent to inform them that the call has been excluded.
Opal stores the entire TPS/FPS database on its network, so once you've subscribed to Datagard you can be confident that you are automatically compliant. This also means that any data the client uses is automatically compliant.
